(b) in so far as is reasonably practicable, take account of any safety representations made by employees. 8.2 UCC SAFETY REPRESENTATIVES (UCC staff elected/selected) Employees have the right to make representations to and consult with their Head of College \ School \ Department \ Centre \ Unit and the ҹ޸þ as their employer on matters of safety, health and welfare in their place of work. In this regard, the main representation and consultation mechanisms within UCC for each employee is via their respective supervisor, Manager, Principal Investigator (PI), Head of Section or Head of College \ School \ Department \ Centre \ Unit. Thereafter staff may refer un-resolved issues to their - designated Safety Representative, who in turn may make representation through the same channels (in line with the responsibilities of said Duty holders under ҹ޸þ Safety Policy). Employees have the legal right to select and appoint from amongst their number at their place of work, a representative (referred to as a "Safety Representative"). The Safety Representative may act for them in consultations with their head of College \ School \ Department \ Centre \ Unit and with the ҹ޸þ, once normal channels have been exhausted. To achieve this, the Enterprise Risk Management Function and the UCC Inter Union Group (IUG) organised an Expression of Interest process during the 2023/2024 period. This initiative led to the selection and training of 23 self-nominated volunteers to serve as Staff Safety Representatives. Each representative is responsible for one or more specific UCC buildings to ensure thorough and effective coverage. Their activities relate only to UCC Staff. Safety Representatives have legal entitlements without any legal responsibilities attaching. Staff Safety Representatives at UCC, operate independent of both the H&S Office and every UCC Safety Advisor. Each of the twenty-three - designated Staff Safety Representatives have the statutory right to such information from a Head of College \ School \ Department \ Centre \ Unit and the ҹ޸þ as is necessary to ensure, in so far as is reasonably practicable, the safety and health of employees at the place of work. To this end, each Staff Safety Representative has entitlements to have their views considered and to have easy access to the local management within Departments, Schools and Functional Areas. Staff Safety Representative may suggest actions to be considered by management & staff but may not direct management or staff actions. It is the duty of each Head of College \ School \ Department \ Centre \ Unit and the ҹ޸þ to co-operate with Safety Representative in the discharge of their role and inform an appropriate Safety Representative when a Health and Safety Authority (HSA) inspector enters a place of work, under the control of the Governing Body, for the purpose of making a tour of inspection. A Staff Safety Representative is legally entitled to: make representations to any Head of College \ School \ Department \ Centre \ Unit or the ҹ޸þ on any aspects of safety, health and welfare at the place of work that is relevant to UCC activities. Management must consider same. have access to information on UCC staff accidents and dangerous occurrences which are reported/ incidents that may require to be notified to the Health and Safety Authority (HSA) investigate UCC staff accidents and dangerous occurrences, provided that he/she does not interfere with or obstruct the performance of any person acting on behalf of the ҹ޸þ or a Regulatory body such as the HSA. make oral or written representations to HSA inspectors on any UCC related safety, health and welfare at work matter. receive advice and information from HSA inspectors on matters of safety, health and welfare at work. carry out safety inspections, subject to prior notice to the relevant Head of College \ School \ Department \ Centre \ Unit and to agreement between the Safety Representative and the ҹ޸þ/the Safety Representatives own Head of College \ School \ Department \ Centre \ Unit as to frequency. (However, in reaching such agreement, which the ҹ޸þ or a Head of College \ School \ Department \ Centre \ Unit may not unreasonably withhold, the ҹ޸þ and the Safety Representatives must consider the nature and extent of the hazards in the place of work when determining the frequency of inspections to be carried out by the Safety Representative). A broad frequency and local notification arrangements and recording arrangements for same will be as agreed by the Corporate Secretary and Director of HR from time to time. subject to prior notice to the College \ School \ Department \ Centre \ Unit or the ҹ޸þ, in circumstances in which it is reasonable to assume that risk of personal injury exists, each Safety Representative may investigate potential hazards and complaints made by any employee whom he/she represents relating to that employee's safety, health and welfare at the place of work; (again within arrangements as will be as agreed by the Corporate Secretary and Director of HR from time to time) and on a request being made in relation to (f) above by a Safety Representative, the Safety Representative may accompany a HSA inspector on any tour of inspection (other than a tour of inspection made by the inspector for the purpose of investigating an accident). Each Head of College \ School \ Department \ Centre \ Unit and the ҹ޸þ is legally required to consider and, if necessary, act upon any representations made by a designated Staff Safety Representative on any matter effecting the safety, health and welfare at work of any employee whom he/she represents. The ҹ޸þ is legally required to afford a Safety Representative such time off from his/her duties as may be reasonable having regard to all the circumstances without loss of remuneration, to enable him/ her to: (i) acquire the knowledge necessary to discharge his/her functions as a Staff Safety Representative, and (ii) discharge his/her functions as a Staff Safety Representative. All subject to a broad frequency and local notification arrangements and recording arrangements for same will be as agreed by the Corporate Secretary and Director of HR from time to time and with due regard for the exigencies of the normal work of the Safety Representative and their department. Arising from the discharge of his statutory functions, a Safety Representative can not be placed at any disadvantage in relation to his/her employment. 8.3 SAFETY CONSULTATION - College \ School \ Department \ Centre \ Unit Level 8.3.1 GENERAL The safety consultative process at College \ School \ Department \ Centre \ Unit level, concerning health and safety and other related issues, should be capable of being effectively used by the staff/ management within each College \ School \ Department \ Centre \ Unit, to disseminate information and resolve all issues arising within the College \ School \ Department \ Centre \ Unit. To supplement local consultation procedures and to cater for the role of the staff elected Safety Representatives the two-tier approach, referred to previously also applies (see Section 8.2). 8.3.2 COLLEGE \ SCHOOL \ DEPARTMENT \ CENTRE \ UNIT SAFETY ACTION TEAM To facilitate effective consultation and partnership at local level each Head of College \ School \ Department may appoint FA or School/ Department level Safety Action Teams (SAT), representing a cross section of experiences and staff grades within the College \ School \ Department \ Centre \ Unit. A SAT, where it exists shall play an active role in assisting the Head of College/School/Department to discharge the consultation and information sharing aspects of legislative obligations applying. They may also assist in aiding an understanding of necessary learning from accidents and dangerous occurrences plus positively influencing school/department safety culture and sampling the effectiveness of the College \ School \ Department \ Centre \ Unit's safety programme. Persons involved shall be afforded time off, to carry out their functions and to undertake relevant training. Note: SAT teams and Staff Safety Representatives do not have any management role in the managing or conducting of occupational health and safety. That is vested in the executive line management/PIs. 8.3.3 SAFETY QUERIES AND CONCERNS Since safety within each College \ School \ Department \ Centre \ Unit is primarily a shared responsibility between management and employees every endeavour must be made to discuss and resolve any/ all queries and concerns at local level. Any member of staff with a safety concern \ problem should firstly endeavour to resolve the issue with their immediate supervisor. If there is a failure to resolve the issue, it should be referred to the College \ School \ Department \ Centre \ Unit Head/Section Head or PI. Having made every effort to resolve issues at local level, any outstanding or unresolved issues may be reported to the relevant Staff Safety Representative. Heads of College \ School \ Department \ Centre \ Unit may also take independent professional advice from College Safety Advisors (where in existence) and ҹ޸þ level safety advisors as necessary.
