In this regard it must be recognised from the outset that any/all workplace focused training, be it safety specific or not, must encompass the legal requirement of: minimising the risks that may exist for the safety, health and welfare of all persons employed by the ҹ޸þ or by third parties complying with all relevant statutory safety requirements regulating the work activities executed from time to time and providing information on hazards, risks, controls/ arrangements and emergency procedures. In addition to the statutory duty to employees as outlined above, the ҹ޸þ also has a common law duty to all undergraduate and graduate students, to provide such training as is necessary, to enable the students to undertake their studies/ research in a manner which, in so far as it is reasonably practicable, is safe and does not give rise to risks to health or expose the individual student or other person to unacceptable levels of risk. The provision of, and extent of, any necessary training is dependant upon the nature of the academic discipline being pursued, the experience and disposition of the students involved, their familiarity with any equipment/substances to be utilised(*), the environment/ conditions where the activities may be discharged and the extent to which supervision is necessary and will be available. Where training is deemed necessary it should adhere to established best practices and university norms. NOTE: Items marked with an asterisk (*) primarily apply to Applied Scientific Departments. 7.2 COLLEGE \ SCHOOL \ DEPARTMENT \ CENTRE \ UNIT RESPONSIBILITIES FOR TRAINING In accordance with the provisions of statutory safety legislation and the ҹ޸þ Safety Policy renewed 2021, each Head of College \ School \ Department \ Centre \ Unit is responsible for discharging in their respective functional areas the statutory duties referred to in 7.1 above. Accordingly each Head must ensure that: all employees (full-time/part-time staff, post doctorate researchers, demonstrators, student help) are adequately trained for all work which they may be required to perform. (SHWW law and common law obligations) all under-graduate and post graduate students are adequately trained for any activities which they may be required to perform pursuant to their course of study (*). Note: this is Common law obligations and is included here as a Risk Management measure rather than a SHWW law requirement ( Note: the latter does not apply to students of the UCC undertaking a course of study at the ҹ޸þ). In the specific case of employees, a principle element of this training will be the requirements, practices and policies outlined in the Dept. Safety Statement and training pursuant to the requirements of specific statutory instruments. Each Head of College \ School \ Department \ Centre \ Unit and Academic who have employees or post- doctorate researchers reporting to them, are responsible for drawing up an induction training programme (in the case of new employees) and an annual safety training programme for their direct reports. (This to include financing the delivery of said training ex department subventions/ income or the delivery of said training either in full or in part). When drawing up such a training plan, each FA and School/ department must compile an annual safety training needs analysis/ gap analysis. Due cognisance must be given to statutory training requirements, knowledge retention times, the value of action based learning, the importance of employees undertaking induction training at the commencement of employment/re-deployment and the value of regular re-fresher training, (particularly where significant risks may exist or where long term behavioural changes are required). Training should also include for safety hazards and measures required relating to academic or work activities which may take place off campus e.g. expeditions, field trips, site visits, job placements, visits to outside companies etc. The concept of what constitutes training should be flexible and non restrictive. Training may encompass brief work place demonstrations, given in the course of the normal daily work routine, (in either a group or on a one to one basis), periods of directed self-study, structured training sessions or formal lectures on specific topics. Training should be progressive and evolutionary and should be linked to downstream evaluations of improvement/changes in work practices/ attitudes. In many cases FAs/ Colleges/ Schools may need to out source and fund the costs of staff H&S training. U/g and p/g student safety training should be delivered similarly of via the academic delivering the course tuition. Some internal support options for staff training are listed below. This should be work specific and delivered by department management. More specific training may be scheduled on an ongoing basis thereafter but preferably prior to the first encounter with any particular activity that poses a hazard/ risk. In addition to the topics covered in 7.2.1 above employee safety training may include any/all of the topics listed below. People transferred to a new job or using unfamiliar equipment or substances (*). 7.3 SPECIFIC TRAINING Most of the general or discipline specific training needs of staff will be as identified in Sections 7.2.1 and 7.2.2. However supplementary or specific training may be required at College \ School \ Department \ Centre \ Unit level, particularly with regard to individual processes, the use of specific machinery, equipment , substances or biological agents (*). Safety in construction and maintenance activities (*) . This is a matter for departments to arrange and fund. Document No. 2 and Document No. 3 of this School/ Department Safety Statement, when completed and customised by the dept., together with any safe operating procedures (*) drawn up by local management will also form the core of any specific on the job training. 7.4 TRAINING NEEDS ANALYSIS AND COMPLETION OF TRAINING RECORDS Each Functional Area AND CONSTITUENT School/Department must compile and maintain a Staff Training Needs Analysis electronic spread sheet of the training required and subsequently planned/ executed for every member of staff within its constituent departments. This to be updated at least annually and submitted with the Heads of Functions Annual Safety Report to the Governing Body. Training records must be maintained for all training undertaken by employees/students. It is the responsibility of local management to ensure that such training records are retained and maintained in the College \ School \ Department \ Centre \ Unit. (It should be noted that the availability of training records will be of prime importance in the event of either Health and Safety Authority intervention/inspection or in defence of a third party compensation claim against the ҹ޸þ).
