Equal Status Acts 2000-2015 "The Acts" (extract)

PART I

3.鈥(1) For the purposes of this Act, discrimination shall be taken to occur where鈥

(a) on any of the grounds specified in subsection (2) (in this Act referred to as 鈥渢he discriminatory grounds鈥) which exists at present or previously existed but no longer exists or may exist in the future, or which is imputed to the person concerned, a person is treated less favourably than another person is, has been or would be treated,

(b)  (i) a person who is associated with another person is treated, by virtue of that association, less favourably than a person who is not so associated is, has been or would be treated, and

(ii) similar treatment of that person on any of the discriminatory grounds would, by virtue of paragraph (a), constitute discrimination,

or

(c) (i) a person is in a category of persons who share a common characteristic by reason of which discrimination may, by virtue of paragraph (a), occur in respect of those persons,

(ii) the person is obliged by the provider of a service (within the meaning of section 4 (6)) to comply with a condition (whether in the nature of a requirement, practice or otherwise) but is unable to do so,

(iii) substantially more people outside the category than within it are able to comply with the condition, and

(iv) the obligation to comply with the condition cannot be justified as being reasonable in all the circumstances of the case.

 

(2) As between any two persons, the discriminatory grounds (and the descriptions of those grounds for the purposes of this Act) are:

(a) that one is male and the other is female (the 鈥済ender ground鈥),

(b) that they are of different marital status (the 鈥渕arital status ground鈥),

(c) that one has family status and the other does not or that one has a different family status from the other (the 鈥渇amily status ground鈥),

(d) that they are of different sexual orientation (the 鈥渟exual orientation ground鈥),

(e) that one has a different religious belief from the other, or that one has a religious belief and the other has not (the 鈥渞eligion ground鈥),

(f) subject to subsection (3), that they are of different ages (the 鈥渁ge ground鈥),

(g) that one is a person with a disability and the other either is not or is a person with a different disability (the 鈥渄isability ground鈥),

(h) that they are of different race, colour, nationality or ethnic or national origins (the 鈥済round of race鈥),

(i) that one is a member of the Traveller community and the other is not (the 鈥淭raveller community ground鈥),

(j) that one鈥

(i) has in good faith applied for any determination or redress provided for in Part II or III,

(ii) has attended as a witness before the Authority, the Director or a court in connection with any inquiry or proceedings under this Act,

(iii) has given evidence in any criminal proceedings under this Act,

(iv) has opposed by lawful means an act which is unlawful under this Act, or

(v) has given notice of an intention to take any of the actions specified in subparagraphs (i) to (iv), and the other has not (the 鈥渧ictimisation ground鈥).

(3B) For the purposes of section 6(1)(c), the discriminatory grounds shall (in addition to the grounds specified in subsection (2)) include the ground that as between any two persons, that one is in receipt of rent supplement (within the meaning of section 6(8)), housing assistance (construed in accordance with Part 4 of the  ) or any payment under the Social Welfare Acts and the other is not (the 鈥渉ousing assistance ground鈥).鈥.

Discrimination for the purposes of this Act.

6.鈥 F14 [ (1) For the purposes of this Act and without prejudice to its provisions relating to discrimination occurring in particular circumstances discrimination shall be taken to occur where 鈥

( a ) a person is treated less favourably than another person is, has been or would be treated in a comparable situation on any of the grounds specified in subsection (2) (in this Act referred to as the 鈥 discriminatory grounds 鈥 ) which 鈥

(i) exists,

(ii) existed but no longer exists,

(iii) may exist in the future, or

(iv) is imputed to the person concerned,

( b ) a person who is associated with another person 鈥

(i) is treated, by virtue of that association, less favourably than a person who is not so associated is, has been or would be treated in a comparable situation, and

(ii) similar treatment of that other person on any of the discriminatory grounds would, by virtue of paragraph (a) , constitute discrimination. ]

 

(2) As between any 2 persons, the discriminatory grounds (and the descriptions of those grounds for the purposes of this Act) are鈥

( a) that one is a woman and the other is a man (in this Act referred to as 鈥 the gender ground鈥),

( b) that they are of different F15 [ civil status ] (in this Act referred to as 鈥 the F15 [ civil status ] ground 鈥),

( c) that one has family status and the other does not (in this Act referred to as 鈥 the family status ground鈥),

( d) that they are of different sexual orientation (in this Act referred to as 鈥 the sexual orientation ground鈥),

( e) that one has a different religious belief from the other, or that one has a religious belief and the other has not (in this Act referred to as 鈥 the religion ground鈥),

( f) that they are of different ages, but subject to subsection (3) (in this Act referred to as 鈥 the age ground鈥),

( g) that one is a person with a disability and the other either is not or is a person with a different disability (in this Act referred to as 鈥 the disability ground鈥),

( h) that they are of different race, colour, nationality or ethnic or national origins (in this Act referred to as 鈥 the ground of race鈥),

( i) that one is a member of the F16 [ Traveller ] community and the other is not (in this Act referred to as 鈥 the F16 [ Traveller ] community ground 鈥).

 

F17 [ (2A) Without prejudice to the generality of subsections (1) and (2) , discrimination on the gender ground shall be taken to occur where, on a ground related to her pregnancy or maternity leave, a woman employee is treated, contrary to any statutory requirement, less favourably than another employee is, has been or would be treated. ]
