In 2009, Prof. Em. Bob Wessels and Dr. Myriam Mailly took the initiative to establish the Younger Academics Network of Insolvency Law (YANIL). It is a branch of the INSOL Europe Academic Forum (IEAF) which brings together postgraduate and PhD students along with early career academics.

Dramatic changes to insolvency law throughout the EU in the last couple of decades have refocused on rehabilitation and rescue instead of liquidation. Rescue frameworks have often introduced conflicts with traditional insolvency law principles such as equality of treatment of creditors, transparency and predictability. This has become even more complicated due to the requirement for judicial cooperation in cross-border insolvency cases.

The Impact of a 鈥楴o Deal鈥� Scenario

This paper examines the impact of a 鈥榥o deal鈥� or 鈥榟ard鈥� Brexit on the recognition of insolvency proceedings commenced in the UK by the remaining Member States of the European Union (EU) post-Brexit. The paper considers the framework currently implemented by the Recast European Insolvency Regulation and the possible approaches when it will cease to apply to proceedings commenced post-Brexit. The paper identifies that there will be no overarching framework in the event that 鈥榥o deal鈥� is reached between the UK and the EU for post-Brexit arrangements, resulting in reliance on individual Member States鈥� domestic laws to determine recognition of insolvency proceedings commenced in the UK.
